Terms of Sale

Please note the following terms, some or all of which may apply to you:

Definitions

  • The following list refers to any employee of, or consultant working for, Viper Web Design Limited.
    • "Viper Web Design", "Viper IT Solutions", "Viper IT", "Viper Hardware", "Viper"
  • The following list are trading names of Viper Web Design Limited.
    • "Viper Web Design", "Viper IT Solutions", "Viper IT", "Viper Hardware", "Viper"
  • Viper Web Design Limited is a registered company in England and Wales, company number: 04286227. VAT registration number: GB 832 1232 71.
  • "Client" refers to any organisation Viper is working for or on behalf off

General Terms - These Conditions of Sale apply to all our customers

Prices and Payment

  • Prices may change without prior notice - please confirm prices prior to confirming your order;
  • Payment is due within thirty (30) days from invoice date unless otherwise agreed, in writing, prior to sale taking place;
  • Under the Late Payment of Commercial Debts Regulations 2002, we can exercise our statutory right to charge interest and an administration charge on all invoices overdue. The interest rate is currently set at 8% over the Bank of England reference rate;
  • All goods remain the property of Viper Web Design Ltd until paid for in full and payment has cleared;

Health & Safety

  • The Client is responsible for ensuring that suitable precautions and measures are in place for safe working by Viper whilst on-site. Any accidents should be reported back to Viper and a formal record kept by the Client;

Telephone Calls

  • We reserve the right to monitor or record telephone conversations for training, security and auditing purposes;

Web Service related

Ownership

  • Viper retain ownership of all documents, scripts, and images created unless otherwise specified;

Copyright

  • Viper owns copyright for all originally created documents, scripts, and images. Any documents, scripts, and images not originally created retain copyright from the creator;

IT Service related

Right to Cancel an Order

  • You have the right to cancel the contact at any time up to 3 working days after you receive the Products by notifying us by email to the email address provided
  • If you cancel the contract under the point above after the Products have been delivered to you, you must return the Products to us at the address shown within the "Contact Us" section of our Website at your own cost and risk. If you cancel the contact before the PRoducts have been delivered to you and then you receive the Products after cancellation you must not unpack them from their packaging but immediately send them back to us. In any event you must return the Products to us within 5 working days of notifying us of cancellation undeer the above point, or if later, of receiving them. If you do not we shall charge you a sum not exceeding the direct costs of recovering the Products.
  • Until you return the Products to us you must keep them in your possession and take reasonable steps to ensure they are not damaged. Provided that we receive the Products within the specified perion in the same condition they were in when delivered to you then we will refund you or credit your account for the Products in question within 7 days of the receipt by us of the Products.
  • Goods are not sold on a trial basis due to sensitivity of products, however, from time to time we are provided with 'trial products' which you may help us to test. These products should be return to us after the test period has completed in the original condition and packaging;

Returns

  • All Goods and spare parts are guaranteed by a minimum 1 year manufacturer's warranty (unless otherwise specified), this is usually a return to base warranty (RTB);
  • All goods within 28 days found to be Faulty will be replaced or refunded according to the manufacturer's warranty;
  • Goods returned after 28 days are subject to the manufacturers warranty policy. Replacement of faulty goods within the guarantee period will be in the form of manufacturers replacement (subject to stock availability). Goods will be returned to supplier or manufacturer for repair/replacement - the Client is responsible for any postage costs incurred;
  • Goods returned for replacement or refund should be complete, in the original packaging and the condition supplied;
  • Returned Systems or parts under warranty are subject to testing within reasonable time period. Non-faults are chargeable;
  • No returned goods can be accepted without the original Invoice (Please keep it safe);
  • Software is subject to its licensing agreement, No refunds given once opened. Please check suitability / compatibility prior to opening;
  • Returned goods not faulty may be accepted at our discretion within 14 days subject to a 30% (or £20 whichever is greater) restocking fee;
  • Special orders are non-returnable / non-refundable and must be paid for in full on ordering;

Guarantee and Liability

  • You get the benefit of the manufacturer's warranty in respect of all the goods we sell. Please note that we do not provide warranties ourselves in respect of the goods and we exclude any warranties express or implied by statute, common law or of any other kind;
  • We are product resellers and as permitted under the Unfair Contract Terms Act 1977, we exclude liability for claims regarding the quality or fitness for purpose of goods or otherwise which consumers can make under the Sale of Goods Act 1979. We are liable for death or personal injury caused by our negligence. We do not accept any liability for indirect or consequential losses of profits;
  • Liability of goods supplied confirmed faulty, are limited to replacement, repair or credit, subject to stock & current prices;
  • Guarantee applies to new hardware only;

Viper reserves the right to change these terms at any time, without consenting the User, publishing new ones here. From time to time the User is responsible for checking the terms and conditions of sale and noting any changes that have come into affect.
